Mumbai: The Special Maharashtra Control of Organised Crime Act (MCOCA) on Monday rejected the interim bail application of Mohammed Sajid Marghoob Ansari, one of the accused in the July 2006 Mumbai train blast stating that there was no provision of bail under the anti terror law.
Sajid Ansari's mother is in a hospital in Mumbai suburbs due to serious illness. The court, though rejected Sajid's bail application, allowed him to visit his ailing mother for six hours with escort if he so wishes after depositing Rs.10, 000 as fees.
"Sajid Ansari had applied for 'Interim Bail' for four week to meet his old aged ailing mother who is on the verge of death. He also promised to surrender to the custody and face further proceeding, and bound to comply with each and every condition decided by the court. However, MCOCA court Special Judge Y D Shinde rejected the application", Advocate Shahid Nadeem Ansari, the Defense Counsel said while talking to ummid.com.
"Sajid Ansari is languishing in Jail since more than six years without committing, abetting or participating in any crime, in any manner knowingly and unknowingly", he added.
Incidentally, Sajid Ansari's sister had died in 2010 and he could not attend her funeral despite the court order as the escort party had reached late at prison.
Sajid Ansari in his bail application pleaded with the court to release him on bail for four weeks. He said his mother is on the verge of death and unconscious and whenever gains consciousness she continuously repeats a sentence "koi mere sajid ko le aaye……. koi mere sajid ko le aaye" (May somebody bring my son Sajid).
However, prosecutor Raja Thakur was not convinced and fiercely opposed the bail application asking the court to reject it.
Meanwhile, since Sajid was unable to pay the escort fees of Rs.10, 000, Jamiatul Ulema Maharashtra deposited the amount on his behalf so as make him visit his mother tomorrow.
