Mumbai:
A designated Maharashtra Control of Organised Crime Act (MCOCA)
court Monday allowed Mohammed Muzaffar Mohammed Tanver, one of the
accused in the 2006 Aurangabad arms haul case, to attend the
wedding ceremony of his only sister in Aurangabad.
Designated Judge S M Modak while
granting the permission directed the accused to bear the
to-and-fro charges of the six police constable who will escort him
to Aurangabad from Mumbai prison where he is presently lodge.
The court while granting the
permission from April 25 to April 28 directed him not to missus
the permission and not to indulge in any objectionable activities
during this period and he will be kept in jail after the sunset in
Aurangabad central jail.
The permission was granted after
defense make an application saying that "Application is more on
humanitarian ground rather than claiming any legal rights and
certain fact are required to be taken into consideration as
accused father was expired long back , mother is sick and he is
the head of the family."
The Court also put the burden on accused
to deposit the escort charges for 12 hours by considering six
police staff which would be approx 54 Thousand. Earlier, the Jail
staff demanded escort charges of 24 hours of six cop which was one lac eight thousand approx.
Adv Farhana shah argued for accused
while Public prosecutor Raja Thackeray were replied on behalf of
state.
It can be remembered that Jamiat Ulama e Maharashtra (NGO) is
providing free legal aid to accused in Aurangabad arms haul case.
