Mahmood Farooqui being exonerated from the rape charges by the Delhi High Court has generated lot of heat in the social media.
It’s a high profile case involving people interacting in high society where consent and rape overlaps. When its consensual and when its forced is difficult to scrutinize when the partners are well known to each other it difficult to judge. The actual veracity of the case has been entwined in this dichotomy.
I personally know this family as Farooqui's wife Anusha is related to my wife. The couple are very high profile media celebrities in the country and both have made the famous film ‘Peepli live.’
Any one who knows the family can believe that Farooqi can indulge in such kind of activity which may be labelled as rape.
Since I know their story from inside I had commented earlier that Farooqui is being framed by a jilted a lover in this case a lady who want to steal a husband from his wife. The lady in question who had cohabited with Farooqui earlier, could find no way to disentangle him from his wife therefore she made this false allegations to destroy Farooqui and his family.
Any other wife in such circumstances could have disassociated with her husband but Anusha conviction and faith in her husband that she backed him and got him come clean.
I had written that the trial court had erred in its verdict by sentencing Farooqui to seven years in jail. The ruling was based on the testimony of the lady who alleged that she was raped.
At that time Faooqui's defense lawyer was weak and could not represent him forcefully with sufficient counter points to defend his case. As a result the accused become guilty and the guilty became prisoner and he was castigated as a rapist. The family had to suffer the ordeal and humiliation that came with that judgement.
However this time Anusha approached Kapil Sibal who agreed to argue Farooqui’s case free of cost in High Court. The judge this time had gone in totality of the case and was convinced that consent and rape overlapped in this case and gave the benefit of the doubt to the accused.
In the final verdict the High Court exonerated Farooqui of the rape charges and asked him to be released immediately.
With this the family is once again united and Farooqui’s credentials re=established. What a relief to Anusha who had stood by his side. It’s a day of deliverance for the family.
