Conspiracy to frame CJI in sex abuse case: SC seeks CBI, IB and Delhi Police chiefs' presence

The court said that further hearing in the matter will be held at 3 p.m. today

New Delhi: The Supreme Court on Wednesday called the Directors of the Intelligence Bureau (IB) and the Central Bureau of Investigation (CBI) and the Delhi Police Commissioner to look into the material furnished by lawyer Utsav Bains in support of his allegations in the framing of Chief Justice Ranjan Gogoi in a false sexual harassment case.

A bench of Justices Arun Mishra, R F Nariman and Deepak Gupta which perused the material submitted to it by Advocate Utsav Bains in a sealed cover said, “if true, it’s a serious matter”.

"We are not disclosing anything in the affidavit (submitted by lawyer Bains in a sealed cover). Very serious issues have been raised", Justice Gupta said.

The court however made it clear that this will not affect the inquiry already set up by the court into charges leveled against CJI Gogoi by a former woman staffer.

“It’s a very serious issue about independence of system…if it can be controlled from other corners,” said Justice Mishra.

The court said that further hearing in the matter will be held at 3 p.m. today.

The Supreme Court bench had on Tuesday issued a notice to advocate Utsav Bains, who has alleged that there is a conspiracy to frame Chief Justice Ranjan Gogoi in a false sexual harassment case.

Noting that the advocate has expressed "apprehension of threat to his safety", the court directed Delhi Police Commissioner to "provide adequate police protection and also to ensure his presence in Court tomorrow (Wednesday)".

The order passed on Tuesday said: "Mr. Utsav Singh Bains, Advocate, is not present today. Issue notice for personal presence of Mr. Utsav Singh Bains, Advocate. We also direct him to produce in this Court the material in support of the averments made in Paragraph Nos. 17 and 20 of the affidavit."

The court had taken suo motu cognizance of the "matter of great public importance touching on the independence of the judiciary" and the affidavit filed by Bains alleging conspiracy.
