New Delhi: Another attempt to get a stay against the Delhi High Court judgement decriminalising gay sex between two consenting adults drew a blank as the Supreme Court today declined to stay the High Court judgement dated July two this year.

Stating that it would wait for the Government to come forward with its response on the issue, Supreme Court however issued notice to the Centre.

 

A bench comprising Chief Justice K G Balakrishnan and Justice P Sathasivam issued notices to the Centre and Naz foundation on the application seeking stay of the operation of the impugned judgement till final disposal of the petition filed by S K Tijarawala, private secretary to yoga guru Baba Ramdev and a Christian organisation, Apostolic Churches Alliance.

The apex court tagged the two petitions along with the petition which is already pending in the court and coming up for hearing on September 11.

The contention of the counsel for the petitioner was that the impugned judgement if not stayed will have disastrous consequences for the society.

 

The apex court had asked the Central Government to file its response within eight weeks on the verdict of the Delhi High Court to decriminalise the homosexual behaviour of consensual adults, which was a crime as per Section 377 of the Indian Penal Code.

 

While hearing a Public Interest Litigation (PIL) filed by Astrologer Manoj Kumar Kaushal, the apex court had refused to give stay to the Delhi High Court's verdict.

 

On July 2, a two Judge bench of the Delhi High Court gave ruling to decriminalise the homosexual behaviour.

 

NAZ Foundation, and other NGOs had filed a petition questioning the criminalisation of homosexual behaviour under Sec 377 of IPC.

Assigning gay marriage legal status is a sign of total disregard of the family institution and the upholding of instincts of depravity and degenerate activities. It would have been better for such people to embrace celibacy or then to channelize themselves to improving the lot of the world. God knows there is enough sorrow which needs to be addressed. While one can probably argue into infinity about the merits or demerits of such relationships, the fact remains that same sex marriages are a hoax, to say the least. All religions have condemned gay sex and there are strong reasons for it. Critics may plead that to prevent or protest against negative behaviors is an infringement of the individual's right to freedom. But the individual's freedom ends where another individual's freedom begins. The question is: How has the government managed to pass this bill in the face of a conservative society like India's? And secondly, why?
