Court allows rusticated MBBS student to sit for exam

New Delhi: The Delhi High Court Friday directed the
Army College of Medical Sciences here to allow a rusticated MBBS
student to sit for the college's internal exams starting June 11.
The petitioner, Pankaj Kumar Tiwari, a final-year MBBS student,
was rusticated for three months in May for alleged indiscipline.
Justice Vipin Sanghi also issued notice to the Army College of
Medical Sciences, Army Welfare Education Society, director general
(Medical Sciences) and Guru Govind Singh Indraprastha University,
with which the college is affiliated, and sought their responses
by July 9.
The court asked the university to give the student an alternative
accommodation outside the campus on his plea to let him stay in
the college hostel since he hailed from Allahabad.
The court orders came during the hearing of Tiwari's plea seeking
suspension of his rustication order passed by the college May 12.
"The petitioner (Tiwari) may be allowed to sit for the VIII-term
examinations. It is also directed that the competent authority
shall take a sympathetic view to give an alternative accommodation
to the petitioner outside the college as his parents stay in
Allahabad," the court said.
Tiwari was rusticated after he allegedly assaulted his classmate
Prabhat Kumar Singh after Singh refused to give him study material
April 1.
Tiwari's advocate contended in the court that Singh was
quarrelsome and several other inquiries were going on against him.
The advocate said Singh had abused and physically assaulted Tiwari,
who acted in self-defence.
Seeking court's order to allow Tiwari to give the examination, he
said his client should have been given a warning or be fined.
However, counsel for the college asked court to dismiss Tiwari's
plea, and said the charges were serious and if one person was
allowed, others would also seek similar benefit from it.
