Court quashes bribery case against Yeddyurappa

Bangalore: The
Karnataka High Court Wednesday quashed Lokayukta's (ombudsman)
indictment of B.S. Yeddyurappa for corruption in an illegal mining
scam which had forced the Bharatiya Janata Party leader to quit as
chief minister in July last year.
In a morale boosting development for Yeddyurappa, the court also
held as "illegal" Governor H.R. Bhardwaj's acceptance of the
Lokayukta report and his direction to the ombudsman to launch
criminal proceedings against the former chief minister.
Justices K. Bhaktavatsala and K. Govindarajulu quashed the FIR
(First Information Report), marking the beginning of formal police
probe, against Yeddyurappa.
"Satyameva Jayate (truth triumphs)", Yeddyurappa, BJP's first
chief minister who is still facing nearly a dozen corruption and
illegal land deals cases, said soon after the order was
pronounced.
The former chief minister told reporters that he will not rush to
Delhi to seek his re-instatement, for which he has been mounting
pressure on party, and "leave it to the party high command to
decide the issue".
"I am not going to ask for anything. It is left to the high
command to decide. I have 100 percent trust in my party leadership
that they will do justice to me," he said.
A spokesperson of the Lokayukta told reporters that the Supreme
Court will be moved against the high court order.
The then Lokayukta N. Santosh Hegde, who had indicted Yeddyurappa
July 27, however, stuck to his findings.
Hegde, whose term ended Aug 2 last year, had found that the
Yeddyurappa family run "Prerana Trust" had received as kickback
Rs.10 crore from South West Mining company and another Rs.20 crore
from it to purchase over an acre of land near Bangalore.
He had recommended that Yeddyurappa be tried for corruption,
following which BJP forced its first chief minister in the state
to quit Aug 4.
Hegde told reporters: "I don't want to comment on the high court
verdict since it becomes contempt. But it is surprising, the trial
should have been taken up. I stick to my report which runs to
26,000 pages. Anyhow, Lokayukta is approaching the Supreme Court
against the quashing, let us see what will be the final verdict."
Justice Bhaktavatsala and Govindarajulu said that Yeddyurappa had
not shown any official favour to the mining company.
Yeddyurappa had petitioned the high court against the Lokayukta
report, Bhardwaj's decision and filing of FIR contending that the
Lokayukta had violated principles of natural justice as he was not
given an opportunity to present his case.
