HC quashes property tax notice issued to Jamia Islamia

New Delhi: The Delhi High Court Wednesday quashed the property tax notice issued by a civic agency to Jamia Millia Islamia for recovery of over Rs.2 crore tax.

The South Delhi Municipal Corporation (SDMC) had Dec 31, 2012, issued a notice to the university for recovery of more than Rs.2 crore in property tax from 2010 onwards.

Justice G.S. Sistani quashed the notice issued to Jamia and termed it as illegal. The court directed the civic agency to be fair and said it should have consulted the Jamia before taking such measures.

The court was hearing the plea of the university against the notice of the SDMC.

Jamia has alleged that the civic agency had "threatened it of coercive action such as attachment of property" for failing to pay the tax.

Counsel Atyab Siddiqui, appearing for Jamia, told the court that the agency had "failed to take the view of the university before issuing the notice and that was in violation of natural justice."

He said the agency had levied property tax on the Jamia treating it as a corporate institution rather than as a central university.
