Australian Court rules farting is not bullying; Engineer files appeal

Melbourne: A worker in Australia who claims his colleague repeatedly farted and “thrusted his bum” at him has appealed against a court ruling that found he was not bullied.

David Hingst, 56, sought a $1.8 million (£970,000) suit against his former employer last year saying his colleague, Greg Short, would “lift his bum and fart” on him up to six times a day, Evening Standard said citing a report by the Australian Associated Press

The Supreme Court of Victoria however found there was no bullying.

Hingst said the flatulence had caused him “severe stress” and appealed the decision on Monday.

"I would be sitting with my face to the wall and he would come into the room, which was small and had no windows. He would fart behind me and walk away. He would do this five or six times a day," Hingst told the Australian Associated Press.

Hingst, who was a contract administrator based in Melbourne, sued Construction Engineering in 2017 but the case was thrown out in April 2018.

Short said at the original hearing he did not recall farting near Hingst but “may have done it once or twice, maybe”. He also denied doing it “with the intention of distressing or harassing Hingst.”

During the hearing, Hingst said he had not received a fair trial and felt the judge had been biased against him. Justice Phillip Priest however said that the trial judge seemed to have shown "remarkable latitude".

"The very distinct impression I get is you were given every opportunity to put your case," he said.

The Court of Appeal will deliver its ruling on Friday.
