The Hague: In another major setback for the far right Zionist regime in Israel, the International Court of Justice (ICJ) Thursday March 28, 2024 announced additional measures to stop the genocide of Palestinians in Gaza.
The ICJ while announcing the additional provisional measures on the request of South Africa also called for immediate lifting of Gaza blockade and unhindered humanitarian aid into the conclave.
South Africa had in December 2023 petitioned before the International Court of Justice (ICJ) accusing Israel of violating Genocide Convention during its brutal military campaign in Gaza.
Following the SA petition, the ICJ on January 26, 2024 announced provisional measures pending the final judgement following two days of public hearing on January 11 and 12, 2024.
South Africa sought additional measures after Israeli Occupation Forces continued its genocidal military offensive in Gaza despite the ICJ verdict on January 26, 2024.
In its latest verdict pronouncing the additional provisional measures, the ICJ said:
“The State of Israel shall, in conformity with its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide, and in view of the worsening conditions of life faced by Palestinians in Gaza, in particular the spread of famine and starvation:
• Take all necessary and effective measures to ensure, without delay, in full co-operation with the United Nations, the unhindered provision at scale by all concerned of urgently needed basic services and humanitarian assistance, including food, water, electricity, fuel, shelter, clothing, hygiene and sanitation requirements, as well as medical supplies and medical care to Palestinians throughout Gaza, including by increasing the capacity and number of land crossing points and maintaining them open for as long as necessary;
• Ensure with immediate effect that its military does not commit acts which constitute a violation of any of the rights of the Palestinians in Gaza as a protected group under the Convention on the Prevention and Punishment of the Crime of Genocide, including by preventing, through any action, the delivery of urgently needed humanitarian assistance”, the ICJ said.
Making the announcement of additional provisional measures, the top UN Court also made it binding on the Zionist regime to abide by it or face action.
“The Court recalls that its orders on provisional measures under Article 41 of the Statute have binding effect and thus create international legal obligations for any party to whom the provisional measures are addressed”, the world court said.
"Since January 26, the catastrophic living conditions of the Palestinians in the Gaza Strip have deteriorated further, in particular in view of the prolonged and widespread deprivation of food and other basic necessities to which the Palestinians in the Gaza Strip have been subjected,” the ICJ said.
The court asked Israel to submit a report on measures taken on the latest order within one month.
In its latest order, the ICJ also confirmed that Israel had submitted on Feb 26 the action taken report on the UN court's provisional measures announced in January.
The ICJ said South Africa has also submitted its observation on the ATR submitted by Israel.
The ICJ additional provisional measures came three days after the UN Security Council passed with an overwhelming majority a resolution calling for immediate ceasefire in Gaza.
Unfazed by the ICJ additional measures and UNSC resolution – both binding, Israel continues massacre of Palestinians in Gaza.
According to Palestine Health Ministry, at least 71 Palestinians have been killed and 112 wounded over the last 24 hours.
Among them, at least 15 people die in an Israeli strike on a sports centre in Gaza City, while injuries reported in the bombing of Saad bin Abi Waqqas Mosque in the Jabalia refugee camp.
Since Oct 7, Israeli Occupation Forces have killed 32,623 Palestinians – majority of them women and children.
