Mumbai: Maharashtra Assembly Speaker Rahul Narwekar Wednesday January 24, 2024 decided in favour of Chief Minister Eknath Shinde saying his faction was the “real Shiv Sena” as it had the support of the majority of the MLAs.
“The Shinde faction had an overwhelming majority of 37 out of the total 55 Shiv Sena MLAs when the rival faction emerged.”
“From my analysis, observation, conclusion and finding Shinde faction was the real Shiv Sena political party when rival faction emerged on 21st June 2022”, the Speaker said reading from a written statement.
At the same time, the Speaker, Rahul Narwekar, also dismissed the disqualification of notices by both the Shiv Sena factions.
"None of the MLAs from either group will be disqualified", the Speaker said.
While Eknath Shinde faction is celebrating the Speaker’s verdict, the Shiv Sena (UBT) supporters are staging protest.
The Shiv Sena (UBT), which is led by Shiv Sena Founder Bala Saheb Thackeray’s son Uddhav Thackeray, has criticized the Speaker’s ruling calling it “murder of democracy”.
"Never seen a more shameless verdict of the tribunal that has murdered democracy", Shiv Sena (UBT) leader Aaditya Thackeray wrote on social media platform X after the Speaker's verdict.
"It is evident that the regime of gaddars are against the constitution given to us by Dr Babasaheb Ambedkar. They want to re write the constitution to finish democracy. Today the verdict has officially killed democracy in our state and the principals and pillars of the constitution", he said.
The Shiv Sena (UBT) has also decided to challenge in the Supreme Court of India the Maharashtra Speaker’s ruling in favour of Eknath Shinde faction.
The Speaker’s verdict came after repeated warning by the Supreme Court of India.
Commenting on the Speaker's ruling,Maharashtra Congress President Nana Patole said:
"The Assembly Speaker's judgment is unconstitutional and undemocratic. It is against party rules. We have faith in the SupremeCourt. Democracy is in danger after this judgment. The BJP will face problems from this judgement."
Slamming the Speaker's verdict, Ruben Mascarenhas, Working President of AAP Mumbai, said:
"Rahul Narwekar has acted more as a BJP spokesperson than as a speaker of the Maharashtra legislative assembly. Whatever is happening in Maharashtra is a huge miscarriage of justice and is a disgrace to India's constitution."
Chief Minister Eknath Shinde and Deputy CM Devendra Fadnavis however hailed the Speaker's ruling.
"A political party cannot be the private property of any one person and if the decision of the party chief is not acceptable, the other members of the party have the right to raise their voice against it", Shinde, who rebelled against Uddhav Thackeray leading to his resignation as Chief Minister in June 2022, said.
During a hearing on a batch of cross-petitions of the groups headed by Uddhav Thackeray and Maharashtra Chief Minister Eknath Shinde, the Supreme Court had stopped short of restoring Uddhav Thackeray as Chief Minister of Maharashtra had he not resigned before the floor test.
