HC rebukes Maharashtra police over custodial death:

Mumbai:
The Mumbai High Court Friday ordered a
CBI probe into the custodial death of 22-year-old Vikhroli resident
Altaf Sheikh and suspended three Ghatkopar police officers till the
investigation gets over.
The court had termed the youth's death
as a "cold-blooded murder''. "Prima facie, we feel it is a case of
death due to torture", stated a division bench of Justice Bilal
Nazki and Justice A R Joshi, refusing to accept the police's claim
that Altaf died of drug overdose.
Altaf was picked up by the Ghatkopar police from his home at
Parksite in Vikhroli around 4 am on September 11, in connection with
a break-in case. Around 10 am, Altaf was sent to Rajawadi Hospital
where he was declared dead; the police insisted that he died of drug
overdose. Later, Altaf's mother, Mehrunisa moved the high court, alleging a
custodial killing by the Ghatkopar police. She has demanded a probe
into the case and a compensation of Rs 25 lakh.
The police in its reply stated that Altaf had consumed six intoxicating tablets, and "could barely
stand". "It is the drug overdose that killed him."
The court,
however,
said the police report was at odds with the autopsy result of the
deceased, Altaf Shaikh from Vikhroli. During the last hearing, the
judges said based on the autopsy report, Altaf's death looked like a
murder in custody.
The court asked the CBI to register an
offence of murder, causing grievous hurt and destruction of evidence
against three officers of Ghatkopar police station, SI Sanjay
Khedekar, head constable Raghunath Kolekar and constable Sanjay
Thombre.
The HC has also directed the agency to
register an offence against the nayab tehsildar who drew the inquest
panchnama. The CBI has been given a free hand to probe the case and
has also been given the liberty to approach the HC if they need
permission to exhume Altaf's body.
Meanwhile, the state government said they would be challenging the
court's verdict. "We will immediately file an appeal in the Supreme
Court against the HC verdict,'' said public prosecutor P A Pol.
The court also rejected the state's
plea to stay the HC order to give it time to approach the apex
court.
