New Delhi: The Supreme Court of India Tuesday January 16, 2024 stayed the Allahabad HC order allowing the survey or inspection of the Shahi Idgah mosque (Shahi Eidgah Masjid) in Mathura, Uttar Pradesh.
In its order, the Allahabad High Court had appointed a Commissioner for the survey of Shahi Eidgah Masjid complex in Mathura.
A bench comprising Justices Sanjiv Khanna and Dipankar Datta passed the interim order while issuing notice on a special leave petition filed by the Shahi Idgah Masjid Committee challenging the Allahabad High Court order passd on December 14.
"The proceedings will go on in the high court, but there will be an interim stay on the appointment of the court commissioner," the Supreme Court bench said.
The apex court also termed "vague" the application made before the Allahabad High Court for appointment of a Court Commissioner for the survey.
"You can't file a vague application for appointment of court commissioner. It should be very specific on the purpose. You can't leave everything to the court to look into it," the Supreme Court said.
The Supreme Court will hear the case again on January 23.
The survey of Mathura Eidgah Masjid was sought by some Hindu petitioners who claimed the mosque was built on Krishna Janmabhoomi on the orders of Mughal Emperor Aurangzeb in 1669-70.
The lawsuit is one of the many by right wing Hindu outfits demanding the removal of the 17th century Shahi Idgah Masjid from the Katra Keshav Dev temple, claiming that the mosque was built on the birthplace of thier Lord Krishna.
