Washington: In the first reaction after the US Court of International Trade blocked most of the tariffs U.S. President Donald Trump had announced in April this year the White House termed the ruling 'Judicial Overreach'.
Talking to reporters, White House press Secretary Karoline Leavitt said the court's ruling Wednesday was beyond its jurisdiction.
“Last night, the Trump administration faced another example of judicial overreach,” Leavitt said.
“Three judges of the US Court of International Trade disagreed and brazenly abused their judicial power to usurp the authority of President Trump,” she added.
Leavitt was responding to the Manhattan-based three-judge Court of International Trade ruling blocking the tariffs announced by Trump that sparked panic in the domestic as well as global markets.
"The President overstepped his authorities with the across-the-board duties on countries that sell more to the United States than they buy", the Court said.
The Court ruled that the Congress did not delegate "unbounded" powers to the President under the International Emergency Economic Powers Act (IEEPA). It only authorises the president to impose necessary economic sanctions during an emergency "to combat an unusual and extraordinary threat," the bench said.
Leavitt however justified Trump's Liberation Day Tariffs saying they were necessary to address the extraordinary threat to the U.S. national security posed by large and persistent trade deficits and to boost manufacturing in the country and reduce reliance on foreign countries.
Leavitt said "courts should have no role here" and that there is a "trend of unelected judges inserting themselves into the legislative process", adding that trade negotiations shouldn't be "railroaded" by them.
"These judges are threatening to "undermine" the US's credibility on the global stage", she said.
She also said the administration will challenge the order in Supreme Court Friday.
"We will win this battle in court," she said, adding that the court is trying to stop Trump from "correcting the wrongs of the past".
