ICJ orders Israel to prevent genocide of Palestinians, submit ATR in a month

The Hague (Netherlands): In a landmark ruling, the International Court of Justice (ICJ) Friday January 26, 2024 asked Israel to use all the power in its hand to prevent genocide of the Palestinians in Gaza.

The International Court of Justice (ICJ), the top court of the United Nations, also asked the Zionist regime in Israel to submit in a month the action taken report about the implementation of its order.

The ICJ in its ruling found that Palestinians were protected under the Genocide Convention, and that there was a case to be heard about whether their rights were being denied in a war that the court said was causing grievous humanitarian harm.

“(Point 1) The State of Israel shall, in accordance with its obligations under the Convention on the Prevention and Punishment of the Crime of Genocide, in relation to Palestinians in Gaza, take all measures within its power to prevent the commission of all acts within the scope of Article II of this Convention, in particular:

● Killing members of the Palestinian group;
● Causing serious bodily or mental harm to members of the Palestinians;
● Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; and
● Imposing measures intended to prevent births within the group”

In a 29-page order, the ICJ further said:

“The State of Israel shall ensure with immediate effect that its military does not commit any acts described in the point 1 above.”

“The State of Israel shall take all measures within its power to prevent and punish the direct and public incitement to commit genocide in relation to members of the Palestinian group in the Gaza Strip”, the ICJ said.

The world court also asked to allow humanitarian aid into the besieged Gaza Strip.

“The State of Israel shall take immediate and effective measures to enable the provision of urgently needed basic services and humanitarian assistance to address the adverse conditions of life faced by Palestinians in the Gaza Strip”, the ICJ said in its ruling.

Ordering Israel once against to prevent genocide of the Palestinians, the ICJ said:

“The State of Israel shall take effective measures to prevent the destruction and ensure the preservation of evidence related to allegations of acts within the scope of Article II and Article III of the Convention on the Prevention and Punishment of the Crime of Genocide against members of the Palestinian group in the Gaza Strip.”

The ICJ stopped short of asking for immediate ceasefire in Gaza but asked Israel to submit the action taken report in a month.

“The State of Israel shall submit a report to the Court on all measures taken to give effect to this Order within one month as from the date of this Order”, the UN court said in its judgement.

The verdict was pronounced by Joan E. DONOGHUE, President of the International Court of Justice (ICJ).

Meanwhile, Israeli Prime Minister Benjamin Netanyahu who has vowed to continue the massacre of Palestinians with and without international and UN support asked his cabinet colleagues to refrain from the ICJ ruling.

According to Israeli broadcaster Kan, Netanyahu, via National Security Adviser Tzachi Hanegbi, instructed government ministers to hold off on any public statements before the release of an official government position on the matter.

Despite Netayhau's warning, Israeli Security Minister Itamar Ben-Gvir, known for hate speeches, mocked the ICJ ruling in a two-word social media post with a Yiddish-style putdown: "Hague shmague".

The International Court of Justice (I.C.J.) conducted two days of public hearing on January 11 and 12, 2024 in response to the South African application filed on December 29, 2023.

On the first day of the hearing, a team of lawyers representing South Africa put in front of the ICJ comprising of 15 judges from different parts of the world evidence in support of the Israeli genocide in the Gaza Strip.

The South African lawyers said the “genocide of Palestinians Israel is committing is a part of the state policy nurtured at its highest levels”.

The South African lawyers deposing before the ICJ also alleged that the Israeli soldiers are celebrating and dancing on music after killing the Palestinians and destruction of Gaza.

The ICJ ruling pronounced today is its first order and provisional measures. The final verdict could take a longer time, some say years.
